By downloading or using the Ear Legend app (the "App"), you agree to these Terms of Use ("Terms") and to our Privacy Policy. If you do not agree, please do not use the App. If you downloaded the App from the Apple App Store, Apple's Standard End User License Agreement also applies. If the two conflict, these Terms apply to the extent permitted.
We give you a personal, non-exclusive, non-transferable licence to use the App on devices you own or control, for your own learning. You may not:
The App, or some of its lessons and features, may be offered for a price. This may be as a paid download, an in-app purchase, a subscription, or a combination of these. The price and what it includes are shown on the App Store or in the App before you buy.
We may change prices, how the App is sold, and which lessons and features are included in a purchase over time. Changes never take away anything you have already paid for during the period you paid for it.
Ear Legend is a learning tool. Progress depends on practice, and we do not promise any particular result, such as passing an exam or gaining perfect pitch.
Please keep the volume at a comfortable level, especially when using headphones, and take breaks. Listening at high volume for long periods can damage your hearing.
Your progress is stored on your device. You are responsible for keeping it, for example by using device backups. If you delete the App or lose your device, we cannot recover your progress. Purchases can be restored with the same Apple ID.
We may update, change or remove features or content of the App at any time, for example to improve lessons or fix problems. Some updates may be needed to keep using the App.
The App is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the App will always be available, error-free or that pitch and rhythm detection will be accurate in every situation, for example with background noise or some microphones.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of or inability to use the App. Our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law.
Purchases are processed by Apple, and your use of the App Store is also governed by Apple's own terms and policies. We are not responsible for services we do not control.
You can stop using the App at any time by deleting it. We may suspend or end your licence if you seriously break these Terms. Sections 7 to 12 continue to apply after these Terms end.
We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. If a change is significant, we will let you know in the App. Continuing to use the App after a change means you accept the updated Terms.
These Terms are governed by the laws of the place where we are established, without regard to its conflict of law rules, and without taking away any protection given to you by the mandatory laws of the country where you live. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the App.
If you have any questions about these Terms, please contact us.
